§ 1

General Provisions

 

1. The Mr. Green Grass online store, available at https://mrgreengrass.co.uk, is operated by Mr Green Grass LTD, Company number 14684038, 22 Chiltern Avenue, Huddersfield, England, HD3 3PF.
2. These Terms and Conditions apply to both Consumers and Businesses using the Store and define the rules for using the Online Store and the procedures for concluding Distance Sales Contracts with Customers via the Store.

 

§ 2

Definitions

 

1. Consumer – a natural person concluding a contract with the Seller via the Store for purposes not directly related to their trade, business, craft, or profession.
2. Seller – MR GREEN GRASS LTD, Company number 14684038, 22 Chiltern Avenue, Huddersfield, England, HD3 3PF.
3. Customer – any entity making purchases via the Store.
4. Business – a natural person, legal entity, or organizational unit without legal personality granted legal capacity by law, conducting business activity in their own name, using the Store.
5. Store – the online store operated by the Seller at mrgreengrass.co.uk.
6. Distance Contract – a contract concluded with the Customer within an organized distance sales system (via the Store) without the simultaneous physical presence of the parties, using one or more means of distance communication up to and including the conclusion of the contract.
7. Terms and Conditions – these Store terms.
8. Order – a Customer’s declaration of will submitted via the Order Form, aimed directly at concluding a Product Sales Contract with the Seller.
9. Account – a Customer’s account in the Store, containing their data and Order history.
10. Registration Form – a form in the Store enabling Account creation.
11. Order Form – an interactive form in the Store allowing Orders to be placed (e.g., adding Products to the Cart and specifying delivery/payment terms).
12. Cart – software element showing selected Products and allowing Order modification.
13. Product – movable goods/services available in the Store as the subject of the Sales Contract.
14. Sales Contract – a contract for the sale of Products concluded between the Customer and Seller via the Store. Includes service contracts where applicable.

§ 4

Technical Requirements

To use the Store (browse Products or place Orders), you need:

 

1. A device with internet access and a web browser.
2. An active email account.
3. Cookies enabled.

 

§ 5

General Information

 

1. The Seller is not liable for Store disruptions caused by force majeure, third-party actions, or technical incompatibility with the Customer’s device.
2. Browsing the Store does not require an Account. Orders may be placed with or without an Account.
3. Prices are listed in GBP and include VAT.
4. The total price includes Product cost and delivery fees (specified during checkout).
5. For subscriptions/open-ended contracts, the total price covers all payments for the billing period.
6. If the Product nature prevents upfront price calculation, the Store will describe how prices/fees are determined.

 

§ 6

Account Registration

 

1. To create an Account, complete the Registration Form.
2. Account creation is free.
3. Log in using the credentials set during registration.
4. Customers may delete their Account at any time by contacting the Seller.

 

§ 7

Order Placement

To place an Order:

 

1. Log in (optional).
2. Select Products and click “Add to Cart.”
3. Choose to check out with or without an Account.
4. If checking out without an Account:
   – Complete the Order Form with delivery details.
   – Confirm by clicking “Buy and Pay” and verify via email link.
5. Select a payment method and pay within the specified timeframe (§8.3).

   1. Royal Mail Standard/Parcel
   2. Courier Service (e.g., DHL, FedEx)

2. Available payment methods:
   1. Cash on Collection
   2. PayPal
   3. Bank Transfer
   4. Credit/Debit Card

§ 9

 

Contract Performance

 

1. The Sales Contract is concluded when the Customer submits an Order via the Store (§7).
2. The Seller confirms Order receipt via email, which constitutes Contract conclusion.
3. Payment deadlines:
   1. Bank transfers/cards: 4 calendar days from Contract conclusion (else Order cancellation).
   2. Cash on delivery: Pay upon receipt.
   3. Collection: Collect and pay within 7 days of readiness notification.
4. Delivery timelines begin:
   1. For bank transfers/cards: After payment confirmation.
   2. For cash on delivery: From Contract conclusion.
5. Delivery covers the United Kingdom. Delivery costs are displayed during checkout.
6. Collection is free of charge.

 

§ 10

Right to Cancel

 

1. Consumers may cancel the Contract within 14 days without giving a reason.
2. The cancellation period starts upon Product receipt by the Consumer or designated person.
3. Submit cancellation via post, email, or the Seller’s website. A template cancellation form is available in Annex 1 to the UK Consumer Contracts Regulations 2013.
4. Exceptions to cancellation rights include:
   1. Custom-made or personalized items.
   2. Sealed Products unreturnable for health/hygiene reasons after opening.
   3. Perishable goods.
   4. Fully performed services with prior consent.
   5. Digital content not on a physical medium if download/access began pre-cancellation.

 

§ 11

Complaints & Warranty

 

1. All Products sold are new.
2. Customers may file complaints under the UK Consumer Rights Act 2015 (statutory rights).
3. Submit complaints in writing/email to the Seller’s address (§3).
4. The Seller responds within 14 days. Failure to respond deems the complaint justified.
5. Return Products to the address in §3.
6. Warranty terms (if applicable) are listed in Product descriptions.

 

§ 12

Alternative Dispute Resolution

 

1. Consumers may use:
   1. The UK’s Resolver service for dispute resolution.
   2. Mediation via the Competition and Markets Authority (CMA).
   3. Free assistance from Citizens Advice.

 

§ 13

Personal Data

 

1. The Seller is the data controller. Data is processed to fulfill Contracts and (with consent) marketing. Recipients may include:
   1. Couriers for delivery.
   2. Payment processors for transactions.
2. Customers may access/rectify their data.
3. Providing data is voluntary but required for Contract conclusion.

 

§ 14

Final Provisions

1. Contracts are concluded in English.
2. The Seller may amend these Terms for legal, payment, or delivery changes. Customers will be notified 7 days in advance.
3. Unresolved matters are governed by UK law, including:
   • Consumer Rights Act 2015
   • Data Protection Act 2018
   • Electronic Communications Act 2000
4. For disputes, Consumers may use the UK’s Alternative Dispute Resolution (ADR) platform.
